Thanks for using MocaShamo Browser ("the Software").

By using the Software, you are agreeing to these terms. Please read them carefully.

Chapter 1.  General rules

1. Accepting the Terms

All Users shall use the Software in accordance with the terms stated in the Terms of Use. Users may not use the Software unless they agree to the Terms of Use. Such agreement is valid and irrevocable. 

Minors may use the Software only with consent from their parents or legal guardian. Furthermore, if Users use the Product on behalf of, or for the purposes of a business enterprise, then that business enterprise shall also be deemed to have agreed to the Terms of Use. Such agreement is valid and irrevocable.

 

2. Modification of the Terms of Use

The developer of MocaShamo Browser ("the Developer") has the right to modify the Terms of Use regarding the updates of the Software. You can check the modified version of the Terms of Use from the Software. You understand and agree that if you continuously use the Software after the date on which these terms have changed, the Developer will treat your use as acceptance and compliance with the updated terms.  

 

3. Scope of License

The Developer gives you non-exclusive, non-assignable license to download, install and use the Software.

 

4. Restrictions

Users shall not engage in the following when using the Software.

  1.  Activities that violate the law, court verdicts, resolutions or orders, or administrative measures that are legally binding.
  2.  Activities that may hinder public order or customs.
  3. Activities that infringe intellectual property rights, such as copyrights, trademarks and patents, fame, privacy, and all other rights of the Developer  and/or a third party granted by the law or contract.
  4. Activities that benefit or collaborate with anti-social groups.
  5. Activities that interfere with the servers and/or network systems of the Software; that abuse the Software by means of BOTs, cheat tools, or other technical measures; that deliberately use defects of the Product; that make unreasonable inquires and/or undue claims such as repeatedly asking the same question beyond the necessity, and that interfere with the Developer's operation of the Software or Users' use of the Software.
  6. Activities that copy all or part of the Software.
  7. Activities that change all or part of the functions, documents or programs of the Software.
  8. Activities that reverse engineer, decompile or extract the source code of the Software.
  9. Activities that sell, rent, loan, deliver, transfer or sub-license the Software.
  10. Activities that use the Software for sales, marketing, advertisement, soliciting or other commercial purposes except for those approved by the Developer, or use the Software for purposes other than the Developer's true intent.
  11. Activities that aid or encourage any activity stated in Clauses 1 to 11 above.
  12. Other activities that are deemed by the Developer to be inappropriate.

5. Exemption of Liability

  1. The Developer does not expressly or impliedly guarantee that the Software is free from de facto or legal flaws(including but not limited to stability, reliability, accuracy, integrity, effectiveness, fitness for certain purposes, security-related faults, errors, bugs, or infringements of rights). The Developer shall not be responsible for providing the Software without such defects.
  2.  The Developer shall not be responsible for any damages inflicted upon Users in relation to the use of the Software.

6. Governing Law and Jurisdiction

Where the Developer has provided Users with a translation of the Japanese language version of the Terms and Conditions (hereinafter referred to as "Japanese Version"), the Japanese Version will govern the relationship between Users and the Developer. In the event of a contradiction between the Japanese Version and a translation、the provisions in the Japanese Version shall take precedence over any other translation. These Terms and Conditions will be governed by the laws of Japan. Conflicts that arise from the Software or conflicts between Users and the Developer related to the Software will be governed primarily under the exclusive jurisdiction of the District Court of Tokyo or the Tokyo Summary Court.

 

 

Chapter 2.  Privacy policy

1. Types of Data Collected

The Developer shall collect following data from the Software:

  • Logs(browser language, the date and time of your request and referral URL, search queries, etc.)
  • Device Information(OS version, types of hardware, resolution, etc.)

2. Purpose of Data Collected

The Developer shall use the acquired personal information for the following purposes listed below:

  • to improve your user experience and the overall quality of the Software
  • to prevent any unauthorized/fraudulent use of the Software
  • to aggregate statistical data regarding the Software
  • to customize the advertising and content you see
  • to provide statistical analyses of our users’ behavior
